Andrew Clyde, R-Ga., dropped a bill this week that does one simple thing: it counts citizens. Just citizens. Not “persons,” not “residents,” not whoever happened to be standing in the country when the Census Bureau came knocking. His bill has a name Washington deserves for once — the Make Apportionment Great Again Act, or the MAGA Act — and its entire premise is that when we decide how many votes in Congress a state gets, we should be counting the people who are actually allowed to cast one.

Radical stuff, apparently.

Here’s what the bill does, in plain terms. It would exclude noncitizens from the population count used to divide up the House’s 435 seats. It wouldn’t force a brand-new census — it would have states reapportion off existing records sometime in 2027. And it tees up a real citizenship question for the 2030 census, asking flat out whether you’re a citizen, a national, a lawful resident alien, or someone here unlawfully. Four boxes. Four honest categories. The kind of question the Census Bureau has spent decades tap-dancing around answering.

Why does this matter? Because right now, under the current rules, a state gets credited with House seats — and therefore Electoral College votes — for people who cannot legally vote in a single election in this country. According to Census Bureau data, immigrants, both citizens and noncitizens combined, make up roughly a fifth of the population in California, New York, New Jersey and Florida. A 2024 analysis from the Center for Immigration Studies found that noncitizens, when folded into the apportionment count, produced a net gain of 14 House seats for Democrat-leaning states and cost Republican-leaning states 10 seats they’d otherwise hold. That’s not a rounding error. That’s the difference between a Speaker’s gavel staying in one party’s hands or moving to the other.

Now, in fairness — because ARES isn’t in the business of handing you a number without the fine print — that 14-seat figure covers all noncitizens, legal immigrants included, not just people here illegally. Other researchers land in very different places. Pew Research pegged the 2020 shift at just three seats if unauthorized immigrants alone were pulled out. A University of Minnesota demographer’s study put the realistic ceiling at five seats under the most generous assumptions for Republicans. And the libertarian Cato Institute has even argued that noncitizen population growth between 2019 and 2023 mostly landed in red states, not blue ones. Nobody serious is claiming this is a clean 24-seat GOP landslide waiting to happen. What’s true is narrower and still enough to matter: there is a real, measurable seat transfer happening because we count people who can’t vote, and the size of it depends entirely on whose model you trust.

Which is exactly why Clyde’s bill matters regardless of whose seat count you believe. If the number is small, Democrats should have no objection to a bill that just asks the question honestly. If the number is closer to CIS’s 14, you now understand in one sentence why the resistance to it will be total.

And you don’t have to guess at the motive. In July, a 2021 clip of Rep. Yvette Clarke, D-N.Y., speaking to the House Foreign Affairs Committee, went viral for saying the quiet part out loud. Talking about Haitian migrants and her Brooklyn district, Clarke said: “I need more people in my district, just for redistricting purposes and those members could clearly fit here.” Not “I want to help refugees find shelter.” Not “my community has capacity.” “Just for redistricting purposes.” Her office did not respond to Fox News Digital’s request for comment on the remark. Nobody in her party has been eager to explain it since.

That single sentence is worth more than any think tank’s model. It’s an elected member of Congress admitting, on the record, that more bodies in her district — regardless of their legal status — means more political power for her party. That’s not an inference ARES is drawing. That’s what she said.

Legally, Clyde has a fight ahead of him. The 14th Amendment apportions House seats by “counting the whole number of persons in each State,” full stop, no citizenship carve-out in the text. Every immigration group and blue-state attorney general in the country will be in court within a week of this bill’s passage arguing exactly that. They may well win. The Constitution’s text is the Constitution’s text, and ARES isn’t going to pretend otherwise to make a headline hit harder.

But here’s the part worth sitting with: the fight itself is the point. For decades, Washington has quietly counted noncitizens for representation purposes and called the conversation closed before it started. Clyde’s bill forces the question into the open — in a Congressional Budget Office score, in federal court, in a floor vote where every member has to go on record. States like California and New York, run by governors like Gavin Newsom and Kathy Hochul, have benefited from a status quo nobody bothered to defend out loud because nobody had to. Now somebody’s making them defend it.

That’s not gerrymandering. That’s not a power grab. That’s a Georgia congressman asking why the people drawing America’s political map for the next decade should count anyone who isn’t part of the electorate that map represents. If the answer requires citing a Brooklyn congresswoman’s redistricting math out loud, maybe the answer was never going to survive daylight.

Sources:

Fox News: “New ‘MAGA Act’ would exclude noncitizens from count used to award House seats”

Fox News: “Immigrants needed for ‘redistricting purposes,’ House Dem admits in viral clip”

WRAL/PolitiFact: “Fact check: How many Congressional seats will Democrats lose if noncitizens are excluded from the Census?”

Center for Immigration Studies: “Immigration Shifts Political Power”

GovTrack: Rep.
