It does not protect alleged forearm slams into federal officers. On Wednesday, August 26, 2026, a 2-1 panel of the U.S. Court of Appeals for the Third Circuit said exactly that about Rep. LaMonica McIver, Democrat of New Jersey. She is not immune from federal prosecution. Two of the three assault counts against her may proceed. The third was remanded to the lower court for further consideration. She has not been convicted. These remain allegations. The law still applies to her.

This was not a MAGA bench stacking the deck. Judge Cindy Chung, a Biden appointee, wrote the majority opinion. Judge Stephanos Bibas, a Trump appointee, joined her. That is a bipartisan rejection of the claim that a member of Congress can wrap physical contact with law enforcement in legislative privilege and walk away. A district court had already ruled the case could proceed. The appeals panel largely agreed.

Chung put it without fog: “We have considered the ‘nature’ of the charged conduct and concluded it is unambiguously non-legislative.” The panel was just as blunt about the alleged acts: “Like the acts charged in Count One, the acts of pushing past and forcibly striking someone are unambiguously non-legislative: they are not integral to the legislative process.”

Count One alleges McIver “slammed her forearm” into a federal officer who was trying to arrest Newark Mayor Ras Baraka. The court said her “alleged intervention into the Mayor’s questionable arrest had no cognizable connection to any legislative function.” Count Two alleges she used both forearms to “strike [an officer] as she returned inside of the secured area of Delaney Hall.” That is the conduct the majority treated as outside the Clause. Members of Congress are not licensed to put hands on federal agents and then call it oversight.

The underlying event was an unannounced May 2025 oversight visit by McIver and other Democratic officials to Delaney Hall, an ICE detention facility in Newark, New Jersey. Baraka was arrested that day. McIver was later indicted on three counts including assaulting and impeding federal officers. Her attorney, Paul Fishman, argued in June that ICE officials obstructed congressional oversight, delayed the inspection, and then “lur[ed]” the lawmakers outside to arrest Baraka. That is her defense theory, and she is entitled to make it. It does not convert alleged strikes on officers into floor speeches.

Judge Thomas Ambro wrote a partial dissent. He agreed that “members of Congress are not above the law.” He agreed that “grabbing” a law enforcement agent to stop the mayor’s arrest is not protected legislative duty. He differed only on Count Two, writing it needs “additional fact-finding to determine whether she shoved him gratuitously, intending to inflict harm, or merely made incidental contact … in an effort to re-enter the facility that federal law authorizes her to inspect.” Even the dissent, on the core claim that she can simply declare immunity, did not give her a free pass on the arrest intervention.

McIver also argued selective and vindictive prosecution. The majority said it lacked jurisdiction on that question. Ambro disagreed. He wrote: “I would allow her discovery into the truth of the matter — not only for her own sake but to safeguard the independence of our legislative bodies.” He added: “Potentially retaliatory prosecutions of sitting Members of Congress are exceedingly rare. But when they do occur, the constitutional foundation of our government is at risk.” He also noted a comparison to Jan. 6, 2021 defendants who assaulted police officers and whose charges were dismissed by the Justice Department at Trump’s request, which he said can support her selective-targeting claim. That argument is on the record, and readers should weigh it. The majority did not take the detour. It decided the Speech or Debate question in front of it: alleged physical interference with officers is not legislating.

McIver answered Wednesday by saying the court “got it wrong,” that she is “exploring every possible option,” that “To protect the people, their elected representatives must be authorized to conduct oversight of the executive branch without fear of retaliation,” and “I will not fold to this administration. The administration will not stop me from doing my job or standing for what is right. This is not over.” Oversight is a real power. The panel did not abolish it. It said the charged conduct, as alleged, is not integral to the legislative process. That is the distinction Democrats always demand when the defendant is someone else.

Equal application of the law is not retaliation. It is the minimum a republic requires. If the conduct alleged here — slamming a forearm into an officer, pushing past and forcibly striking another — is a crime for an ordinary citizen, it does not become a protected legislative act because the person doing it holds a House seat from New Jersey. Chung and Bibas — one appointed by Biden, one by Trump — treated the Clause as written, not as a Democratic get-out-of-court card. Ambro agreed she is not above the law on the arrest intervention and asked only for more fact-finding on one count.

Two counts move forward. One goes back for further consideration. The allegations still have to be proved, and McIver is entitled to the presumption of innocence and to her day in court. What has already been decided is the principle that should have been obvious: Congress writes the laws. It does not get to put hands on the officers who enforce them and then hide behind the Speech or Debate Clause. The Third Circuit said no. That is not partisan theater. That is the Constitution applied to a member of Congress the same way it applies to everyone else.

Sources:

Fox News — “Trump scores federal court win against House progressive accused of assaulting ICE” (Aug. 26, 2026)

Roll Call — “Rep.
