On the afternoon of August 6, 2026, the 68-year-old retiree was working in his own yard on Francis Court when, according to police, he noticed a burglary in progress next door. A little after 5:09 p.m., he was stabbed to death on his own property. Three decades on that street, ended in minutes.

Here is the sentence Sacramento’s political class is praying you never assemble in your own head: the man now charged with killing him was walking free that day only because a judge appointed by Gavin Newsom decided he should be.

Let that timeline sink in, because the state won’t say it plainly, so I will.

The suspect, Marcos Iriarte-Valdez, 36, was already facing the system. Prosecutors say he committed two residential burglaries — with people home — in Orinda back on April 29, 2026. For that, California did what California does: it let him out on pretrial release. On August 4, he was hauled back into custody for violating the terms of his own home-detention monitoring. Caught breaking the rules of his leash, in other words.

And then came August 5. Contra Costa Superior Court Judge Nichelle Holmes — appointed to the bench by Democratic Governor Gavin Newsom in 2024 — ordered Iriarte-Valdez released on his own recognizance and sent him right back to the same home-detention monitoring he had just violated. No cash bail. No cell. Just a promise and an ankle monitor.

One day later, Todd Stewart was dead.

Iriarte-Valdez has now been charged by the Contra Costa County District Attorney with one count of murder, with enhancements alleging the killing happened during a burglary, involved a knife, and occurred while he was out on conditional release in that separate burglary case. He has been denied bail. An ICE detainer has been placed on him. He was arrested at his Martinez home on Friday, August 7. He is charged, not convicted, and he is entitled to his day in court — a courtesy, it must be said, that his alleged victim was never granted.

Now, the establishment will want to argue about paperwork. The Department of Homeland Security first called Iriarte-Valdez an “illegal alien” on social media, then later said he had been “legally admitted” to the United States in 2007. Fine. Fight about the immigration label all you want. It does not rescue anyone in this story. Whatever box you check on his status, the fact that buried a good man is simpler and uglier: a Newsom judge had a repeat burglary suspect in custody for breaking his release terms — and chose to open the door.

And if you want to understand that choice, Judge Holmes told you who she was years ago. In a 2017 interview with her alma mater, the University of San Francisco School of Law, she offered her philosophy of the job: “Coming to work every day and ensuring that justice is served is my way of protesting.” And this: “Justice does not always mean a prison sentence. Sometimes it means a treatment program, or intensive counseling, and sometimes it means a dismissal.”

Sometimes it means a dismissal. Remember that line. That is not a rogue interpretation of the law — that is the worldview California’s leaders deliberately elevated to the bench. When a judge treats her courtroom as a stage for “protest” and treats dismissal as a form of mercy, the mercy flows in exactly one direction: toward the accused, and away from the Todd Stewarts of the world.

Some in Sacramento have had enough. Assemblymember David Tangipa, R-Fresno, said Stewart “should be alive today,” and did not mince words about why: “This murder was 100% preventable if we just enforced the laws currently in place. But Governor Newsom’s garbage sanctuary laws and activist judges are leading to the death of Americans. Californians deserve a justice system that protects innocent Americans first.”

And what did the Governor’s office offer? A spokesperson declined to defend Holmes’ specific decision to release him — telling, isn’t it? — and pivoted to the feds, insisting the suspect “should face justice for his alleged crime” and that “California takes public safety seriously, and nothing in California law prevents federal authorities from enforcing federal immigration law.”

Takes public safety seriously. Tell it to the family on Francis Court.

This is the sanctuary bargain laid bare. The politicians get to feel righteous. The judges get to “protest” from the bench. And ordinary Californians — men like Todd Stewart, home more than thirty years, minding his own yard — get handed the bill. It was paid in full on August 6, and no amount of press-release compassion will refund it.

One day. That is all the distance California’s justice system put between a man it had in custody and a 68-year-old with a knife in his own front yard. Remember that the next time they tell you they are keeping you safe.

Sources:

Fox News —
