A GMAIL ACCOUNT AND TWO BOTTLES OF WINE: FAUCI’S TOP ADVISER JUST PLEADED GUILTY TO HIDING THE COVID RECORD

OPINION / COMMENTARY

For six years the lab-leak question was a conspiracy theory you were not supposed to ask out loud. On Tuesday the man who sat at Anthony Fauci’s right hand walked into a federal courthouse in Greenbelt, Maryland, and pleaded guilty to a felony for hiding how that question got handled.

Dr. David M. Morens, 78, of Chester, Maryland, pleaded guilty to one count of conspiracy to commit offenses and to defraud the United States. He was a senior advisor in NIAID’s Office of the Director from 2006 through 2022 — sixteen years inside the room. He faces up to five years in prison. U.S. District Judge Paula Xinis sentences him on November 12. He was indicted in April.

Read what he admitted to, because the government’s own language beats anything I could write.

According to the Justice Department, NIH terminated a grant titled “Understanding the Risk of Bat Coronavirus Emergence” over allegations that COVID-19 emerged from the Wuhan Institute of Virology. NIAID had awarded that grant to an entity DOJ calls “Company 1” and a person it calls “Co-Conspirator 1,” who made a subaward to the Wuhan Institute of Virology itself. After the termination, Morens and a second co-conspirator pledged to help restore it and to “counter the narrative that COVID-19 leaked from a lab.”

Then comes the part that ends the argument about whether any of this was innocent. Anticipating FOIA requests, DOJ says the conspirators “agreed in writing to intentionally hide their communications from public view” by corresponding through Morens’s personal Gmail account rather than his official NIH email.

In writing. They wrote down the plan to hide the writing.

What moved through that account, per his plea: non-public NIH information. Coordination on efforts to influence NIH to fund Company 1. Edits to drafts of letters addressed to NIH leadership. And “back-channel” information to a figure DOJ identifies only as “Senior NIAID Official 1.” The conspiracy ran from April 2020 to June 2023. Three years.

Now the wine.

Morens admitted that Co-Conspirator 1 gifted him wine for his “behind-the-scenes shenanigans” and arranged for delivery to his Maryland residence. The government says Morens then identified an official act he could perform to “deserve” the gift — authoring a scientific commentary in a prominent medical journal advocating that COVID-19 had natural origins. Co-Conspirator 1 dangled more: meals at Michelin-starred restaurants in Paris, New York and Washington, D.C.

Reporting puts the wine at two bottles of Napa red running about forty dollars, described in a June 2020 email as a “phase II gift.”

Forty dollars. That is apparently the going rate for a senior federal scientist to go shopping for an official act to repay a favor.

Here I am going to be straighter with you than some outlets on my own side. The Justice Department did not name Co-Conspirator 1, Co-Conspirator 2, Company 1, or Senior NIAID Official 1. News organizations report that Co-Conspirator 1 is believed to be EcoHealth Alliance president Dr. Peter Daszak, that Company 1 is believed to be EcoHealth Alliance, and that Senior NIAID Official 1 is believed to be Fauci. Believed. Reported. Not named by the government in this document — and you should hold it that way until it is.

And Anthony Fauci was not charged in this case. Say it plainly. If we start pretending otherwise, we become the thing we spent six years complaining about.

He is not having a quiet summer regardless. On July 29 he repeatedly invoked the Fifth Amendment before the Senate Homeland Security and Governmental Affairs Committee. This month, Republicans on that committee voted along party lines to hold him in contempt of Congress and referred him to the Justice Department; he then declined a request to appear voluntarily before a second Senate panel. Joe Biden pardoned him on the way out the door for anything he might have done between January 2014 and January 2025.

Fauci told a House committee in June 2024: “With respect to his recent testimony before this Subcommittee, I knew nothing of Dr. Morens’s actions regarding Dr. Daszak, EcoHealth, or his emails.” Sen. Rand Paul released Fauci’s diary entries last month, and reporting on them describes several private discussions with Morens about the bat coronavirus grants. Those two things sit uneasily together. No jury has been asked to reconcile them.

Morens’s attorney, Timothy Belevetz, said: “By pleading guilty today, Dr. Morens has taken responsibility for what he did, and he will continue to do so.” Morens had previously denied to Congress that he attempted to evade federal transparency laws, and apologized in earlier hearings for his handling of federal records. FBI Director Kash Patel posted on X on Tuesday that “This FBI investigation remains ongoing. No one is above the law.”

The other side gets a hearing here. NPR reports that many researchers still hold that the weight of the available evidence suggests the virus emerged naturally, and Jennifer Jones of the Union of Concerned Scientists warned that “Criminal prosecution of scientists is a classic authoritarian tactic.”

Fair enough. But Morens was not prosecuted for reaching a scientific conclusion. He was prosecuted for concealing federal records — records that belong to you — and he admitted it in open court. FOIA and the Federal Records Act are not scientific instruments. They are the mechanism by which a self-governing people audits the officials it pays.

Strip out the virology and this is an ordinary corruption story sitting on top of an extraordinary question. A senior official moved public business onto a private account precisely so the public could not see it, accepted a gift from an interested party, and then went looking for an official act to justify the gift.

The origin question may never be settled to everyone’s satisfaction. That is exactly why the paperwork mattered. When the evidence is contested, the record is the only referee in the building — and these men agreed, in writing, to burn it.

Sentencing is November 12. Patel says the investigation is ongoing. That plea document describes two co-conspirators. Only one of them has pleaded guilty.
